Welcome to Hexoscale LLC (“Hexoscale,” “we,” “our,” or “us”). By using our services, including our Dead Lead Reactivation System, you agree to these Terms of Service (“Terms”). Please read them carefully.


1. Services

Hexoscale provides automated lead reactivation services via email and SMS for businesses, primarily HVAC contractors. Our services are designed to contact leads who have previously shown interest in your business, with the goal of increasing engagement and appointment rates.

All messaging is automated and monitored to comply with TCPA, CAN-SPAM, and carrier-specific A2P requirements.


2. Eligibility

By using our services, you represent and warrant that:

You are a business or authorized representative of a business.

You are at least 18 years old or have authority to enter this agreement.

You have obtained express, verifiable consent from all leads to receive automated marketing communications via email and SMS.

You will maintain records of all lead consents in a format that is audit-ready for at least 4 years, including timestamps, IP addresses, and method of consent.

Ruthless note: This ensures you cannot provide unconsented leads without explicit risk acknowledgment.


3. Compliance & Legal Requirements

Hexoscale operates in compliance with:

TCPA (Telephone Consumer Protection Act) – U.S. automated SMS/phone rules

CAN-SPAM Act – U.S. email marketing rules

Carrier-specific A2P requirements – including message templates, throughput, and delivery monitoring

International laws where applicable, including CASL (Canada) and GDPR/ePrivacy (EU)

You are solely responsible for ensuring the leads you provide are valid opt-in contacts and that all messages sent via our platform comply with applicable laws. Hexoscale is not liable for messages sent to unconsented or invalid contacts.


4. Automated Messaging

By using our system, you acknowledge and agree that:

Messages are automated, relevant, and may be personalized.

STOP/HELP automation is mandatory:

STOP → immediately unsubscribes the lead from all future messages. No further messages will be sent.

HELP → returns automated instructions for managing subscription preferences and contacting your business.

Messages include clear opt-out instructions in every email and SMS.

You will not use our services to send spam, fraudulent, illegal, or unsolicited content.

Message frequency and throughput will comply with carrier-imposed limits. Messages exceeding approved limits may be delayed or blocked.

5. Limitation of Liability

Hexoscale will make commercially reasonable efforts to provide reliable services but is not liable for:

Lost revenue, leads, or business opportunities

Delays, failures, or message blocking caused by carriers, email servers, or third-party platforms

Legal consequences arising from your failure to obtain proper consent or comply with messaging laws

Account suspension or termination due to non-compliant lead lists or messaging behavior

You acknowledge that messaging is subject to carrier and regulatory review, and Hexoscale cannot guarantee uninterrupted delivery.


6. Privacy & Data Protection

Hexoscale values your privacy and operates as follows:

Lead data is stored securely, encrypted, and never sold.

Lead data is used exclusively for reactivation purposes within the scope of your contract.

Data handling complies with applicable privacy laws (U.S., Canada, EU, and other jurisdictions).

All consent records, STOP/HELP logs, and message histories are stored for a minimum of 4 years for audit purposes.

7. Termination

Hexoscale may suspend or terminate your access immediately if:

You violate any of these Terms.

You provide leads without proper consent or send messages that violate STOP/HELP rules.

You use our services to send spam, fraudulent, illegal, or abusive content.

Required by law, regulatory authority, or carrier A2P compliance audits.

You may terminate your account at any time by contacting [email protected].

8. Recordkeeping & Audit

You must maintain all records of consent, messaging logs, STOP/HELP interactions, and audit trails for at least 4 years.

Hexoscale may request access to these records in the event of compliance audits. Failure to provide them may result in service suspension or termination.


9. International Compliance

For leads outside the U.S.:

Canada: CASL compliance required

European Union: GDPR & ePrivacy compliance required

Other jurisdictions: follow local consent and messaging laws

Hexoscale assumes no liability for your failure to comply with non-U.S. regulations.
