Welcome to hexoscale llc (“hexoscale,” “we,” “our,” or “us”). By accessing or using our services, including the Dead Lead Reactivation System (the “Services”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.


1. Services

hexoscale provides communication and lead-nurturing services for businesses, including automated follow-up systems designed to support engagement with existing contacts. Services may include email and other electronic communications initiated on behalf of the client.

All Services are provided in a manner intended to support compliance with applicable laws and industry requirements, including TCPA, CAN-SPAM, CASL, GDPR/ePrivacy, and carrier or platform A2P standards. hexoscale does not guarantee outcomes, delivery rates, or business results.


2. Eligibility and Authority

By using the Services, you represent and warrant that:

You are a business entity or an authorized representative of a business.

You have full authority to enter into these Terms on behalf of that business.

You are at least eighteen (18) years of age or otherwise legally authorized to enter into this agreement.

All contact data you provide was collected with valid, express consent to receive communications related to your business.

You agree to maintain records of consent in an audit-ready format for a minimum of four (4) years, including reasonable documentation of the method, timing, and source of consent.

hexoscale relies on your representations regarding consent and does not independently verify the original collection of contact data.


3. Compliance and Legal Requirements

hexoscale operates its Services in a manner designed to support compliance with applicable communication and privacy laws, including but not limited to:

Telephone Consumer Protection Act (TCPA) – United States

CAN-SPAM Act – United States

Carrier and platform-specific A2P requirements

Applicable international regulations where relevant, including CASL (Canada) and GDPR/ePrivacy (European Union)

You are solely responsible for ensuring that all contact data you provide and all communications initiated through the Services comply with applicable laws and regulations. hexoscale is not liable for communications sent using unconsented, invalid, or unlawfully obtained contact data.


4. SMS Messaging Use Cases, Data Rate Disclosure, and Opt-Out Instructions

By using the Services, you acknowledge and agree that hexoscale llc may send SMS messages to customers who have explicitly opted in to receive communications. Messaging is limited to the following use cases:

Appointment confirmations, reminders, and updates including date, time, location, and assigned service provider

Additional service-related notifications, where applicable

Marketing or promotional messages only when a separate, explicit marketing consent has been provided

Standard message and data rates may apply according to the recipient’s mobile carrier plan. hexoscale llc is not responsible for any charges applied by the carrier.

Message frequency will be limited to what is reasonably required for the applicable use cases and disclosed during opt-in. Typical messages may be sent in connection with specific appointments or service events; recurring or ongoing messaging will be disclosed at the time consent is obtained.

Recipients may reply STOP to unsubscribe from all future SMS communications at any time. After responding STOP, no further messages will be sent to that number, subject to reasonable processing time. Recipients may reply HELP to receive instructions on managing messaging preferences or for support contact information.

All messaging is designed to comply with applicable laws and carrier requirements, including TCPA, CAN-SPAM, CASL (Canada), GDPR/ePrivacy (EU), and A2P 10DLC standards. Opt-in and opt-out records, including timestamp, source, and method of consent, are maintained for audit and compliance purposes for a minimum of four (4) years.

SMS communications are informational and permission-based, and no messages will be sent to contacts without valid, verifiable consent.


5. Automated Communications

Communications may be sent using automated systems and may include personalization based on available information. You agree not to use the Services to send spam, deceptive, fraudulent, unlawful, or unsolicited communications.

Message delivery, frequency, and throughput are subject to carrier, platform, and regulatory limitations. Communications that exceed approved limits or violate applicable requirements may be delayed, filtered, or blocked.


6. Limitation of Liability

hexoscale will use commercially reasonable efforts to provide reliable Services; however, hexoscale is not liable for:

Lost revenue, leads, profits, or business opportunities

Delays, failures, filtering, or blocking caused by carriers, email providers, or third-party platforms

Legal or regulatory consequences resulting from your failure to obtain proper consent or comply with applicable laws

Account suspension or termination resulting from non-compliant use of the Services

You acknowledge that communications are subject to carrier review and regulatory oversight and that uninterrupted delivery cannot be guaranteed.


7. Privacy and Data Protection

hexoscale maintains administrative, technical, and organizational safeguards to protect data processed through the Services. Lead data is used solely for purposes related to providing the Services and is not sold.

Records related to consent status, opt-out activity, and communication history may be retained for compliance, audit, and legal purposes.

8. Termination

hexoscale may suspend or terminate access to the Services if:

You breach these Terms

You provide contact data without valid consent

You engage in activity that violates applicable laws, regulations, or platform requirements

Suspension or termination is required by law, regulatory authority, or carrier or platform review

You may request termination of your account at any time by contacting [email protected].


9. Recordkeeping and Audit

You agree to maintain records of consent and related documentation for a minimum of four (4) years. hexoscale may request reasonable confirmation of compliance in connection with audits, carrier inquiries, or regulatory reviews. Failure to provide such information may result in service suspension or termination.


10. International Use

If you provide contact data for individuals located outside the United States, you are responsible for ensuring compliance with applicable local laws, including but not limited to CASL and GDPR/ePrivacy requirements.

hexoscale does not assume responsibility for non-U.S. regulatory compliance.
